1. Our trade policy

1.1
The Hamradioshop products present in our Hamradioshop online catalog and the commercial services provided are available to end users, defined by law as "Consumers" and "non-Consumers".
The product offers as well as their prices are valid as long as they are still visible and purchasable on Hamradioshop and in any case while stocks last.

1.2
"Consumer" means, pursuant to art. 18 of the Consumer Code, a natural person who acts for purposes that do not fall within the framework of his commercial, industrial, artisanal or professional activity. We ask you to kindly include your "VAT number" in your personal data if you do not fall into the Consumer category.

Hamradioshop reserves the right not to process orders received from users who do not adhere to our. trade policy.

These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of purchase orders regarding the products present on the Hamradioshop site between users of the Hamradioshop portal and the Hamradioshop company of Tersigni V. Dino itself addressed to people who have reached the age of majority (18 years old).

The general terms and conditions of sale do not regulate the supply of services or the sale of products carried out by third parties who use direct links to the Hamradioshop site through banners or other hyperlinks. Before sending orders and purchasing products and services from these third parties, we suggest checking the general terms and conditions of sale and use of these third parties, since Hamradioshop under no circumstances can be held responsible for the supply of services promised by third parties or for the execution of electronic commerce transactions between Hamradioshop users and third parties.

2. How a contract with Hamradioshop is concluded

To send an order to purchase one or more products on the Hamradioshop website you must complete all the pages in the cart and electronically transmit the page with all the personal and purchase data to Hamradioshop, following the instructions you will find after adding a product to the cart and registered for purchase.

The order page contains a link to these general terms and conditions of sale and also contains information on the main characteristics of each product ordered and its price (all applicable taxes included), the type of payment you used to purchase, the conditions for the delivery of the products, the contributions required for delivery and transport as well as references to the general terms and conditions for the return of products purchased online.

2.3
An order will be considered sent when Hamradioshop receives your order proposal electronically and the information relating to the order has been preliminarily verified as correct.

2.4
Before forwarding your order proposal to Hamradioshop for the purchase of the selected products online, you will be asked to carefully read the general terms and conditions that regulate the sale and purchase, to print a copy of the same using the option to print and save or request a copy for personal use.

2.5
The order proposal will be stored in our databases for the time required to process your order, as required by current legislation. You can access the order by clicking on the section called "MY PROFILE" or by contacting Customer Service. Furthermore, a copy of the IT evidence relating to the conclusion of the contract will be kept for the time required by the applicable civil and tax regulations.

Before proceeding with sending the order, you will be asked to identify and correct any possible errors that may have occurred when filling in the fields.

The submission of orders to Hamradioshop must be in Italian.

After your order has been registered by Hamradioshop, it will be processed as soon as possible.

2.9
Hamradioshop may not accept and process your order if there are no sufficient guarantees of payment solvency, if the orders are incomplete or incorrect, or if the products are no longer available. In the above cases, we will inform you by email that the contract has not been executed and that Hamradioshop has not confirmed your purchase order specifying the reasons. In addition to the information provided, Hamradioshop is not able to give more precise information regarding the availability of the product; therefore, once your order has been examined, we will inform you via e-mail if some products you ordered are not available.

Without prejudice to the provisions of the General Conditions, it is understood that this order has as its object divisible, distinct sales services for multiple economic units, equal to the number of products ordered, as expressly agreed between the Customer and Hamradioshop with the forwarding of the order itself and its acceptance; therefore, in the event that Hamradioshop's execution of the order is limited to some of the products ordered due to the unavailability of some or for another justified reason independent of Hamradioshop's will, by submitting this order the Buyer declares his interest and gives its consent to the partial execution of the order regarding the other products, which therefore cannot be refused by the Buyer, nor can it give the Buyer the right to revoke the order itself.
In the event that Hamradioshop is not able to fully accept the order received from the Customer, giving rise to partial acceptance of the order with regard to the available products, the possible exercise of the right of withdrawal provided for by the art. 8 of these General Conditions will take place without any charge for transport costs to the Customer.

2.10
You are aware that by sending the order to Hamradioshop you accept without reservation all the provisions contained in the general terms and conditions of sale of this contract with Hamradioshop and that you undertake to observe them. If you do not agree with some provisions contained in these general terms and conditions of sale, we ask you to kindly not send the order for the purchase of products on Hamradioshop.

For cash on delivery orders, in the event of non-delivery, various storage and shipping costs will be required.

By sending the order to Hamradioshop you agree and accept these general terms and conditions of sale as well as further conditions contained on Hamradioshop also through links, including the general terms and conditions of use, the Privacy Policy and the withdrawal terms.

When an online order is confirmed, Hamradioshop will send you, at your choice, in written form or via e-mail the content of which must be stored on a durable medium, a copy of the purchase order receipt, containing a summary with the information relating to the order (general terms and conditions of sale, the main characteristics of the products purchased, detailed information on the price, payment terms, existence of the right of withdrawal, times and methods for returning the products, contribution for the transport requested to the customer, the geographical address where any complaints can be submitted and information on existing commercial guarantees and assistance services).

2.13
By sending the order to Hamradioshop you agree to receive the invoice/tax receipt/receipt issued for tax purposes in electronic format. You will be able to receive the paper invoice by making an express request to our Customer Service.

3.Guarantees and indications on product prices

3.1
On Hamradioshop we offer for sale the products purchased from Hamradioshop directly from manufacturers, suppliers and traders carefully selected for their rigorous and stringent quality controls.

3.2
The products on sale by Hamradioshop are of a quality that is never inferior to the standard of the reference market.

3.3
The main characteristics of the products are indicated on Hamradioshop on the product web page. The products offered for sale on Hamradioshop may not correspond exactly to reality in terms of image and colors due to the browser or type of monitor used. The images may be for indicative purposes only.
The technical characteristics of a product, the approvals and safety declarations of a HRS brand product and of any other product sold through the Site are indicated in the packaging or in the instructions for use of the product itself and can be reported in full or in extract on the Site same as accompanying the illustration of the Product.
All HRS brand products comply with the standards and are approved according to the provisions of the European Community regulations. We are not responsible for any discrepancies with the standards of countries not belonging to the European Community and/or lack of approval of the products in the same countries.

3.4
The price of the products is expressed in euros and includes VAT, excluding transport costs which will be determined once the cart is complete. Prices are subject to change. Check the final sales price before sending the order proposal.

3.5
Orders placed from a site in a different country than the one where the goods are delivered, or to addresses to which Hamradioshop cannot deliver (e.g. PO BOX. or territories/areas/zones not reached by our couriers), will be automatically cancelled.

3.6
All products are delivered with an identification label/plate attached or sealed. Do not remove the seals of the purchased products or the label/tag if you wish to return the purchased product.
We are in no way responsible for incorrect information or data and any technical or other inaccuracies provided by third parties that may be contained on Hamradioshop or indicated in the products.

3.7
Should you decide to exercise your right to return the products purchased from Hamradioshop, we remind you that Hamradioshop has the right not to accept returned products that have been altered from their original condition or have been damaged (e.g. without a tag or warranty seal).

3.8
All products are covered by the guarantee for defects of conformity, lasting no less than 24 (twenty-four) months, provided limited to the Italian territory of the Vatican City State and the Republic of San Marino ("Legal guarantee of conformity for goods of consumption) provided for by Title III, Chapter I of the Consumer Code (art. 128 et seq.), for purchases with a VAT number the guarantee will last 12 months.

The guarantee, provided for the duration indicated above and within the specified territory, applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the documentation technique or instructions for use attached. In the event of a lack of conformity, we will, at our expense, restore the conformity of the product through repair/replacement or reduce the price, subject to possible termination of the contract if necessary.

Warranty assistance is provided upon presentation of the purchase document and is always ex-store.

We reserve the right to replace the product (at our discretion even with a product with superior characteristics) or to terminate the sales contract with refund of the entire sum paid and any additional expenses in the event that, for any reason, it is possible to restore or replace a Product under warranty.

We are not responsible for any delays in carrying out repairs or replacements by third parties and/or the manufacturer.

In cases where the return of the product is envisaged in order to benefit from the warranty, the product must be returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc. .).

We guarantee compliance with the quality standards relating to our products exclusively up to the moment of delivery. Our liability deriving from improper use of the products subsequent to the time of delivery is excluded.

4. Payments

4.1
Payment of the product prices and related transport contributions must be made using one of the procedures indicated during the online purchase phase.

4.2
In the case of payment by debit/credit card, all the relevant details (for example, card number or expiration date) will be managed directly on the Paypal online payment site, which provides electronic payment services, without third parties parties have access to it. These details will not be used directly by Hamradioshop. We will always carry out the entire payment management procedure through the same payment manager: therefore both your purchase or refund, in accordance with the exercise of your right of withdrawal, or for cases reported as possible fraud by the public security authorities. The price for the purchase of the products and the related delivery fees, as indicated in the order confirmation, will be charged to your credit/debit card when the purchased products are shipped.

4.3 If, for any reason, it is not possible to charge the amount due, the sales process will be automatically canceled and the sale will be resolved. You will be informed via appropriate automatic email communication.

5. Hamradioshop Web Discount Coupons

5.1
Hamradioshop web discount coupons are personal electronic codes that allow you to take advantage of a discount on your purchase from Hamradioshop.

5.2
The box where you can enter the Hamradioshop Coupon discount code is displayed on the first page of the cart: after you have placed your items in the cart and set your electronic code, press the confirmation button to view the new purchase total.

5.3
Limitations on the use of web vouchers:

the voucher can only be used once, with the exception of returns (as specified in paragraph 5.4); the voucher can never be exchanged for money; you cannot use more than one voucher per order unless otherwise stated in the voucher itself; the voucher can only apply to items with a value greater than the voucher itself;
the voucher cannot be used for some items on sale as unique samples or for sales for charitable purposes;
the web voucher cannot be used in any way in Hamradioshop stores.

5.4
If for any reason you are not satisfied with your Hamradioshop order, you can return the item to which you applied the web voucher following the standard return procedure, as described in the section dedicated to Returns. Once your return is accepted, the respective voucher code will be restored to its original value. The difference in price between the voucher and the item you purchased will be fully refunded, following the standard refund procedure.

6. Transport and delivery of products

6.1

Shipping

Shipments made by express courier are carried out by our trusted couriers or, if expressly requested, can be collected by the buyer's trusted carrier.
The goods are intended to be delivered ex works to our warehouse. The goods travel at the risk of the recipient even if shipped free port . The shipment can be insured against theft and even partial damage at the buyer's request by agreeing additional costs with the seller. To make this insurance effective, the carrier's receipt of shipments with packages missing or damaged, even partially, must be done " subject to internal control ". The copy of the "conditional" acceptance of the shipment must be sent to us with the notification of any damage or theft.
Approximately an online order is delivered to the carrier within 24 hours. The carrier delivers the goods within 24/48 and within 5 days for the smaller islands (these times are however not binding).

For shipments to remote locations, smaller islands of Venice and the Venetian lagoon, a variable supplement will be required depending on the courier used (+7/10 euros)

Pursuant to art. 54 of the Consumer Code, the execution of the purchase order will take place through delivery of the products within a maximum of 30 days, starting from the date of the order and upon payment of the price.

8. Returns of goods & right of withdrawal.

8.1
You can return the products purchased from Hamradioshop without any penalty and without specifying the reason, within fourteen (14) working days of receiving the products purchased from Hamradioshop

8.2
To return the products, please contact Customer Service before sending the return package to Hamradioshop.

8.3
You must return the items to Hamradioshop by contacting us and returning the goods within fourteen (14) working days from the date you received the products.

8.4
The right of withdrawal - in addition to compliance with the terms and procedures described in paragraphs 8.1, 8.2 and 8.3 above - will be considered exercised correctly once the following circumstances have been fully respected: we invite you to correctly complete and send the request for returned online; the products must be returned intact, complete with accessories, in their original packaging (in the case of audio CDs, books, drawing objects, toys, the packaging must include the relevant original seal; if you want to return a set/kit, must include all the relevant components); the returned items must be sent to Hamradioshop within fourteen (14) working days from the delivery date to the address indicated by the Customer Service operators.
The right of withdrawal is not permitted in the case of:
a) purchase of sealed packaged products, returned with the packaging no longer sealed;
b) products that are not substantially intact or that show damage, discrepancies, deterioration and/or alterations of any kind;
c) used;
d) damaged;
e) goods which by their nature cannot be returned or which risk deteriorating.

REFUNDS FOR ORDER CANCELLATION

1 If you request the cancellation and refund of an order of products marked as "Coming soon", "Not immediately available" or "Ask for delivery times", paid by credit card or PayPal, the costs will be deducted from the refund of bank commissions paid on the transaction.
